Welcome to Maros. These Terms of Service ("Terms") govern your use of the Maros platform and services. By using Maros, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Maros, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services. If you are using Maros on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Maros is a platform for art provenance research and documentation. We provide:

  • Artwork registration and MID assignment
  • Document upload and AI-powered provenance extraction
  • Provenance timeline management and visualization
  • Access to museum artwork records
  • Collection organization tools
  • Provenance reporting

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Accept responsibility for all activities under your account

You must be at least 18 years old to create an account.

4. MID System

When you register an artwork, Maros assigns a unique MID (Maros Identifier). You acknowledge that:

  • MIDs are permanent identifiers that cannot be reassigned
  • A MID does not constitute proof of ownership, authenticity, or provenance
  • Maros does not verify the authenticity of artworks
  • You are responsible for the accuracy of information you provide

5. User Content and Data

You retain ownership of all content you upload to Maros, including artwork images, documents, and provenance information ("User Content"). By uploading User Content, you grant Maros a limited license to:

  • Store, process, and display your content to provide our services
  • Process documents using AI to extract provenance information
  • Generate reports and visualizations from your data
  • Display public artwork pages for artworks you choose to make public

You represent that you have the right to upload and share any content you provide.

6. Acceptable Use

You agree not to:

  • Upload content that infringes intellectual property rights
  • Provide false or misleading provenance information
  • Use Maros to facilitate fraud or illegal activity
  • Attempt to access other users' accounts or data
  • Reverse engineer or attempt to extract our source code
  • Use automated systems to scrape or collect data
  • Interfere with the proper functioning of the service
  • Violate any applicable laws or regulations

7. Report Disclaimer and AI-Generated Content

Important: Maros provenance reports are generated using automated analysis and artificial intelligence applied to documents and data provided by you, the user. By using our services, you acknowledge and agree that:

  • Best-effort analysis: Maros applies its best analysis and judgment to the documents and information you provide. However, the accuracy and completeness of our reports depend on the quality, legibility, and completeness of the source materials you submit.
  • Possibility of errors: Despite our best efforts, errors in extraction, interpretation, or analysis are always possible. You are solely responsible for reviewing and verifying all information in your reports before relying on it.
  • No warranty of accuracy: Maros does not warrant or guarantee the accuracy, completeness, or reliability of any extracted data, provenance timelines, risk assessments, or other report contents.
  • Not professional advice: Our reports are informational tools to assist with provenance research. They do not constitute legal, financial, or professional advice, and are not a substitute for independent verification by qualified professionals.
  • No authentication: Maros does not authenticate artworks, verify ownership claims, or certify provenance. Our reports reflect automated analysis of the documents you provide, not independent verification.
  • Limitation of liability: Maros shall not be held liable for any decisions, actions, losses, or damages arising from reliance on information contained in our reports. You assume all risk associated with the use of our services.

By creating an account, you confirm that you have read, understood, and accepted this disclaimer.

8. Subscription and Payment

Certain features require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees
  • Provide valid payment information
  • Authorize recurring charges for subscription plans

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time; access continues until the end of the billing period. Refunds are provided in accordance with our refund policy.

9. Disclaimer of Warranties

MAROS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties regarding the accuracy, reliability, or completeness of content
  • Warranties that the service will be uninterrupted or error-free

Maros does not authenticate artworks, verify provenance claims, or provide legal advice. Our services are tools to assist with research, not guarantees of authenticity or ownership.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAROS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Business interruption
  • Costs of procurement of substitute services
  • Damages arising from reliance on AI-extracted information

Our total liability shall not exceed the amount you paid to Maros in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Maros and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Intellectual Property

Maros and its original content, features, and functionality are owned by Maros and are protected by intellectual property laws. The Maros name, logo, and "MID" designation are trademarks of Maros. You may not use our trademarks without written permission.

13. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination:

  • Your right to use Maros ceases immediately
  • You may request export of your data within 30 days
  • MIDs assigned to your artworks remain valid but are no longer editable

You may close your account at any time through your account settings.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or prominent notice on the platform. Continued use after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Texas.
